§ 1 Scope

(1) These terms and conditions apply to all our deliveries of goods and the provision of services by us based on orders placed through our online shop at www.einbaukuechen-by-tm.de. Amendments or supplementary agreements to these terms and conditions require confirmation by authorized representatives of our company registered in the commercial register to be valid and apply only to the individual transaction. All other employees are not authorized to agree to amendments or supplementary agreements to these terms and conditions. Any differing terms and conditions of the customer do not apply unless expressly accepted by us in writing in a specific case.

(2) The offers on the internet apply exclusively to orders placed via the internet. The offers are directed at consumers and businesses. According to Section 13 of the German Civil Code (BGB), consumers are natural persons who enter into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. According to Section 14 of the German Civil Code (BGB), businesses are natural or legal persons or partnerships with legal capacity who, when entering into a legal transaction, act in the exercise of their commercial or independent professional activity.

(3) We do not store the contract text. The customer can print these terms and conditions and the order details after submitting their order using the function in their browser and will also receive an order confirmation in accordance with legal requirements, which contains the entire contract text.

§ 2 Conclusion of Contract

The products offered in our online shop www.einbaukuechen-by-tm.de do not constitute an offer to conclude a purchase agreement, but merely an invitation to submit such an offer. The customer only submits an offer to conclude a purchase agreement by submitting the fully completed order form via the designated button. After receiving this online order, the customer will receive an order confirmation from us via email. This does not yet constitute acceptance of the contract by us. We are merely fulfilling our legal information obligations. Acceptance only occurs through a separate order confirmation via email or by shipping the goods to the customer. We reserve the right to accept the order within a period of up to three days from the date of the customer's order.

§ 3 Prices

(1) The prices quoted by us are gross prices and include the applicable statutory value added tax.

Goods will only be ordered if a deposit of 45% is paid; the deposit is due within 3 working days of placing the order.
For orders placed in our online shop at www.einbaukuechen-by-tm.de, the minimum order value (merchandise value) is €20.00. Please note that "merchandise value" refers to the price including VAT after any discounts have been applied, but excluding shipping costs.

(3) For each delivery, the shipping fee communicated to the customer before placing his order in the online shop will also apply.

(4) There is no obligation to erect and/or assemble the equipment.

§ 4 Means of Payment
(1) Generally, you can pay by bank transfer or PayPal. However, we reserve the right not to offer certain payment methods for any given order and to refer you to other payment methods, which are also free of charge. There is no entitlement to a specific payment method.

(2) The customer may only offset undisputed or legally established claims.

(4) In the case of payment via PayPal, payment is due upon conclusion of the purchase agreement.

§ 5 Purchase on acco
